Renting in Dubai: what your landlord may actually add

The number that decides your renewal is not the asking price on a portal. It is the gap between what you pay now and what the Land Department's index says your building is worth — and Decree No. 43 of 2013 turns that gap into one of five fixed percentages.

The five bands

Your rent sits below the index byMaximum increase at renewal
less than 10%none
11–20%5%
21–30%10%
31–40%15%
more than 40%20%

Read the first row twice, because it is the one that does the work. If your rent is already close to what the index says the unit is worth, the lawful increase is zero — not a small rise, not a negotiation. The percentages only start once the landlord can show the unit is let materially under the index.

The index values the building, not the postcode

Article 3 of the decree defers to the Rent Index of the Emirate of Dubai, approved by RERA. On 2 January 2025 the Land Department replaced it with the Smart Rental Index, which classifies each building on its technical and structural characteristics, the quality of its finishes and maintenance, its strategic location and spatial value, and the level of services and facilities available. It covers all residential areas in Dubai, including special development zones and free zones.

For a community of 75 buildings that matters more than it would elsewhere. A community-wide average is not what the index returns and not what a tribunal would look at; the service answers per unit, and the usual way to identify the unit is its DEWA premise number.

Who it binds

Article 2 is short and wide: the decree applies to all landlords of the public and private authorities in the Emirate of Dubai, including the special development areas and the free zones, including the Dubai International Financial Centre. There is no category of landlord in Dubai that the bands do not reach.

The scale is worth knowing too. The Land Department recorded more than 900,000 registered rental contracts in 2024, up 8% on the year before. A registered contract is what the index is built from, and it is also what you would rely on in a dispute — which is the practical argument for Ejari registration separate from the legal one.

The bands cap an increase at renewal. They are not a rent freeze, not a cap on what a new tenancy may be agreed at, and not a substitute for the notice a landlord must give. Check the index for your own unit before accepting a figure, and treat any percentage quoted without a unit reference as a starting position rather than a calculation.

How much of the community your landlord's building belongs to is actually finished is on the section front. For the day-to-day view of a block — which way it faces, how far the promenade is — the resident's guide is at riviera.dst.llc. If the question is ownership rather than tenancy, that runs through the qualifying-property page.

How much can my landlord raise the rent in Dubai?

It depends on how far below the index your current rent sits. Decree No. 43 of 2013 allows no increase where the rent is less than 10% below the average market rate, then 5%, 10%, 15% and 20% as the gap widens past 10%, 20%, 30% and 40%.

Where does the average market rate come from?

Article 3 of the decree points to the Rent Index of the Emirate of Dubai, approved by RERA. Since 2 January 2025 that is the Smart Rental Index, which values each building rather than each area.

Can I look up the figure for Azizi Riviera?

Not by community. The Land Department's rental-index service answers per property — you identify the unit, typically by its DEWA premise number, and it returns the index for that unit. Two flats in different Riviera buildings can return different numbers.

Does the cap apply in free zones?

Yes. Article 2 applies the decree to all landlords, public and private, including special development areas and free zones, and including the Dubai International Financial Centre.

What if the landlord asks for more than the band allows?

The band is the legal maximum at renewal, not a suggestion. A disagreement about it is what the Rent Disputes Settlement Centre exists for; the decree that created it, No. 26 of 2013, is cited in the preamble of the one that sets the percentages.
